The Special Mission of the Organization of American States (OAS) for the Strengthening of Democratic Institutions in Guatemala welcomes the swearing-in of Gabriel Estuardo García Luna as Attorney General of the Republic and Head of the Public Prosecutor's Office for the 2026-2030 term.
The Mission values the fact that the renewal of leadership of the Public Prosecutor's Office took place on the scheduled date. A substantive phase now begins in which the initial decisions of this institution's new administration will be decisive for strengthening institutional independence, constitutional legality, professionalism, human rights, and public trust.
This new phase must translate into verifiable actions, including an orderly internal transition; the protection of the prosecutorial career; the technical strengthening of investigations; respectful cooperation with the other branches of government; and the adoption of clear criteria to ensure that criminal prosecution is conducted objectively, without undue pressure or political bias.
The Mission emphasizes that one of the main challenges of the new administration will be to address, in accordance with the law and with full respect for due process, the concerns expressed by various national and international sectors regarding the misuse of the criminal justice system to criminalize certain actors and guarantee impunity for others. An effective institutional response to these cases and structural situations will be an important signal regarding the direction of the Public Prosecutor's Office and its commitment to human rights.
Likewise, the Mission calls on all political, social, economic, and institutional actors to contribute responsibly to this new phase, refraining from interference, reprisals, or pressure that could affect the autonomous exercise of prosecutorial functions.
The Special Mission will continue to monitor this process in accordance with its mandate to provide technical support and strengthen democratic institutions in Guatemala.
