Rep. Gill Bill to Revoke Birthright Citizenship for Illegal Aliens

Washington, D.C. - Congressman Brandon Gill (TX-26) today introduced the Citizenship Act, a bill to classify unlawful entrants and birth tourists as invaders. This legislation would clarify that the children of illegal aliens who entered our country as part of an invasion are not entitled to birthright citizenship under the Fourteenth Amendment.

"The Constitution was never intended to reward unlawful entry by automatically granting citizenship to the children of those who invaded our country," said Rep. Gill. "If we are serious about recognizing that our nation has been invaded, then our laws should reflect that reality. We should not extend one of the greatest privileges our nation can bestow, American citizenship, to the children of those who entered our country unlawfully as part of that invasion. I'm proud to introduce the Citizenship Act in the House to remedy our code of law."

Senator Jim Banks (R-IN) introduced companion legislation in the Senate.

"The Supreme Court's birthright citizenship decision was an unprecedented assault on American sovereignty, and we must do whatever it takes to save our country," said Sen. Banks. "I'm leading the Citizenship Act to reverse the effects of this consequential ruling and ensure the millions of illegal aliens that invaded our country can't continue to exploit our immigration system."

Background:

  • Some have claimed the Supreme Court settled this issue, but that is simply not true. The Court's decision in Barbara v. Trump did not address whether the children of illegal aliens who entered during an invasion are entitled to birthright citizenship.
  • On January 20, 2025, President Trump declared that the United States was facing an invasion at our southern border. That declaration built on years of action by Texas. In November 2022, Governor Greg Abbott invoked his constitutional authority under Article I, Section 10 to defend Texas against what he identified as an invasion by foreign drug cartels and illegal immigration.
  • Governors across the country recognized the seriousness of the crisis. By 2024, 15 states had deployed National Guard troops to Texas to help secure the border.
  • In November 2025, every Republican member of the Texas congressional delegation publicly supported Governor Abbott's invasion declaration in a letter to the Departments of Justice and Homeland Security.
