Bankruptcy Noticing Center Outage (BNC) Update

Effective October 26, 2026, BAE Systems, the vendor that operates the Bankruptcy Noticing Center (BNC), will begin processing certificates of notice for orders and notices collected on October 7th from CM/ECF servers (known as "polling") and will resume mailings for orders and notices collected from court servers on October 8th. Polling for backlog work will proceed using a phased approach, with new work being polled simultaneously.

Electronic notices will be transmitted as quickly as possible following validation, allowing multiple backlog days to be worked concurrently once processing capacity is established. Print notices will be staged separately and released in prioritized waves based on available production capacity and mailing readiness. To mitigate the issue of notices having become stale during the disruption, BAE will include a message on the address page for all paper notices generated between October 13th to present, as follows:

IMPORTANT NOTICE: The enclosed notice(s) may have been sent later than intended because of a service disruption affecting the Bankruptcy Noticing Center. The information in this notice is still valid, but because of the delay, a deadline or response period listed here may have passed and you may receive an amended notice. Should you have questions regarding a deadline or a response period, please contact your attorney or visit the website of the clerk's office of the court named on this notice.

BAE Systems may post additional information on its website to address stale notices.

On Friday, October 23, 2026, the Executive Committee of the Judicial Conference, on behalf of the Conference, declared a "Bankruptcy Rules emergency" under Rule 9038. Even with BNC services resuming, this emergency declaration will continue to be necessary to allow full restoration and assurance that parties are not prejudiced by the outage.

Additional information will be provided as it becomes available.
