The below statement is jointly issued by the Colorado Department of State and Colorado County Clerks Association.

Denver, October 7, 2026 - The Colorado Department of State and Colorado County Clerks Association discovered on October 6 that Ballot Issue 7A was included on more voters' ballots than it should have been in Adams, Arapahoe, Douglas, and Weld Counties.

This measure was referred to voters by the Front Range Passenger Rail District (FRPRD), which did not adequately communicate the District's updated boundaries to counties following a 2026 change in law. The District has since sent a letter to the Counties to clarify the boundaries for the district.

To establish a clear path forward for both voters and county partners, the Department of State has issued guidance so that counties only tabulate the votes for Ballot Issue 7A from eligible voters within the updated district boundary.

What Voters Should Know

Voters should vote the ballot they were sent.
The Department of State and County Clerks Association are working with the impacted Counties to ensure that only eligible voters have their vote in this contest counted.
Voters who received Ballot Issue 7A but who do not reside within the FRPRD boundaries will have their ballot counted, with the exception of Ballot Issue 7A.
Ballot processing does not begin until October 19. No votes have been tallied in this contest at this time.
