Lockport Man Pleads Guilty for Causing Fatal Collision with Motorcyclist in Sanborh

Erie County District Attorney Michael J. Keane announces that Nicholas J. DiCarlo, 28, of Lockport, pleaded guilty this morning before Niagara County Court Judge Mario A. Giacobbe to one count of Manslaughter in the Second Degree (Class C felony). DiCarlo pleaded guilty, as charged, to the sole count of the indictment.

On Thursday, July 17, 2025, at approximately 8:56 p.m., the defendant was driving westbound on Saunders Settlement Road in Sanborn when his vehicle crossed into the eastbound lane as another vehicle ahead turned into a parking lot between Chew Road and Walmore Road. The defendant caused a head-on collision with a motorcyclist who was traveling in the eastbound lane. The victim, 26-year-old Hunter S. Weber, died at the scene. The defendant's actions recklessly caused the death of the victim. The investigation determined the defendant was traveling at 75 mph in a 45-mph zone and using a mobile device at the time of the crash.

Erie County District Attorney's Office was appointed as the Special Prosecutor to handle the prosecution of this case after the Niagara County District Attorney's Office recused itself from the matter.

DiCarlo faces a maximum of 15 years in prison when he is sentenced on Wednesday, December 2, 2026, at 10:00 a.m. Our prosecutor requested that the defendant be held without bail while pending sentence. Judge Giacobbe continued his released on previously posted bail.

DA Keane commends Chief Michael Salada, Investigator Brandon Comerford, Investigator John Penzotti and Captain Maria Battista of the Lewiston Police Department for their work in this investigation as well as victim advocate Cathy Mitchell.

The case was prosecuted by Assistant District Attorney Christine O. Murray and Chief Patrick B. Shanahan of the Vehicular Crimes Bureau.
