Narrative Summary:

COMPLAINT:

On May 5, 2026, NFA's Business Conduct Committee (BCC) issued a Complaint against Hardee Brothers LLC (Hardee Brothers) and Sidney C... urtis Hardee (Hardee), charging them with willfully submitting and providing materially false or misleading information to NFA or its agents; cheating, defrauding or deceiving or attempting to cheat, defraud or deceive a customer; misappropriating customer funds; and failing to observe high standards of commercial honor and just and equitable principles of trade. The Complaint also charges Hardee Brothers with soliciting a customer with a disclosure document NFA had not reviewed and accepted and commingling pool assets with firm assets.

DECISION:

On July 22, 2026, NFA's BCC issued a Decision, pursuant to Hardee Brothers and Hardee's settlement offer, and ordered Hardee Brothers to withdraw from NFA membership and not reapply for NFA membership or be listed or act as a principal of an NFA Member at any time in the future. In its Decision, the BCC also ordered Hardee to withdraw from NFA associate membership and not apply for NFA membership, reapply for NFA associate membership, or be listed or act as a principal of an NFA Member at any time in the future.
