REQUEST: A Modification of Existing Minor Conditional Use Permit (CUP) to upgrade from a Type 41 ABC license (On-Sale Beer and Wine for Bona Fide Eating Place) to a Type 47 license (On-Sale General for Bona Fide Eating Place) and a Determination of Public Convenience and Necessity (PCN) for an on-sale alcohol license for an existing 2,458 square foot sit down restaurant located on a lot measuring approximately 0.18 acres and Zoned C-2 (General Commercial).

ENVIRONMENTAL DETERMINATION: Staffanalyzed the proposal for California Environmental Quality Act (CEQA). The proposed project is exempt under Guidelines Section 15301 - Existing Facilities, Class 1of the CEQA Guidelines.This section consists of no expansion of existing or former uses.

STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve a Minor Conditional Use Permit for onsite alcohol license Type 47 by adopting Resolution No. R-02-25 titled:

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF COLTON ADOPTING A MODIFICATION TO A MINOR CONDITIONAL USE PERMIT (CUP) TO ALLOW ALCOHOL (TYPE 47 ON-SALE GENERAL, BONA FIDE EATING PLACE) LICENSE AND A DETERMINATION OF PUBLIC CONVENIENCE AND NECESSITY (PCN) FOR THE ON-SALE ALCOHOL LICENSE TO AN EXISTING RESTAURANT LOCATED AT 531 S.
