A report published on 3 February 2026 by the Committee on the Judiciary of the US House of Representatives[1] details activities by the European Union which, according to the authors, pose a serious threat to freedom of expression in the United States. The document examines, among other things, how the EU's Digital Services Act forces global technology platforms to apply censorship. The authors point to numerous instances of pressures by the Commission, which seeks to limit political debate under the guise of fighting disinformation and hate speech. The points made in the report about the Commission censoring lawful content during political elections in individual EU Member States are particularly worrying. This poses a real threat to freedom of expression, the security of election campaigns and, consequently, the credibility of elections. The report identifies very specific examples of such activities being undertaken by the Commission during election campaigns in six EU countries.

In light of the above, could the Commission answer the following questions:

  • 1.On what basis and for what purpose did it undertake the measures set out in the above-mentioned report with a view to curbing lawful, free discussion during election campaigns in Romania, Ireland, the Netherlands, Slovakia and France?
  • 2.Did it undertake similar measures during the election campaigns in Poland in 2023, 2024 and 2025?
