The President of the Personal Data Protection Office on AI and data protection at the CMS & Microsoft 2.0 conference

On 18 June 2026, Mirosław Wróblewski, President of the Personal Data Protection Office, took part in the CMS & Microsoft 2.0 conference entitled 'Further deadlines for the AI Act on the horizon, and here comes… the Omnibus'.

During the event, the key issues relating to the implementation of legislation on artificial intelligence, personal data protection and cybersecurity were discussed.

The President of the Personal Data Protection Office spoke about cooperation with the new AI regulator - the Commission for the Development and Safety of Artificial Intelligence - and the need to ensure consistency in the actions of the bodies responsible for overseeing digital regulations and the development and use of artificial intelligence systems.

- "State authorities should and must cooperate with one another. I hope that during the second legislative phase there may be time to reconsider the provisions setting out the details of procedural cooperation," said Mirosław Wróblewski. The President of the Personal Data Protection Office also expressed the hope that standards of conduct regarding AI would be developed, similar to those agreed between the President of the Personal Data Protection Office and the President of the Office of Competition and Consumer Protection. In his remarks, Mirosław Wróblewski also emphasised that he enjoys an excellent working relationship with the Minister for Digital Affairs.

He also addressed concerns regarding the structure of the proposed AI regulations. One such concern is that administrative decisions made by the President of the Personal Data Protection Office are subject to review by administrative courts. Under the AI Act model, however, this mechanism is overseen by the Competition and Consumer Protection Court.

- "At the next stage of the legislative process, we need to develop more precise solutions," emphasised Mirosław Wróblewski.

The discussion also covered AI-powered profiling, the risks associated with deepfake technology, the protection of children's and adults' images online, and the relationship between personal data protection and new obligations in the field of cybersecurity.

Mirosław Wróblewski acknowledged that we have good provisions in national legislation, but that we rarely make use of them in the fight against, for example, deepfakes. He also expressed dissatisfaction with law enforcement agencies' approach to enforcing existing legislation. He was referring to a recent decision by the public prosecutor's office to close an investigation into the case of a minor whose image had been used by her peers to generate a nude image of her.

The President of the Personal Data Protection Office also emphasised the importance of educational initiatives in the area of image protection and combating abuse involving the use of artificial intelligence.

- "We need to educate young trainees and probationary judges in this area - and provide continuous professional development for judges and prosecutors. I have been told by people within the profession that judges and prosecutors are not adequately prepared. However, the knowledge is available. We have good relations with the Ministry of Justice and the National Public Prosecutor's Office - we are open and ready to cooperate in this area," noted Mirosław Wróblewski.

For many years, the Personal Data Protection Office has been running information campaigns, publishing educational materials and participating in initiatives to raise awareness of the risks associated with publishing images of children online and using them to create harmful content, including deepfakes.
