ATTORNEY GENERAL RAOUL ANNOUNCES SETTLEMENT WITH MAKERS OF POSH E-CIGARETTES

Chicago - Attorney General Kwame Raoul today announced a settlement with the entities responsible for distributing Posh, one of Illinois' bestselling disposable vape brands. The settlement resolves allegations the entities violated the Illinois Youth Prevention Vaping Act by selling unauthorized flavored e-cigarettes and marketing those products in ways that are attractive to youth.

"Today's settlement ensures one of the most prolific vaping brands in Illinois will no longer sell unauthorized e-cigarettes with flavors that appeal to youth," Raoul said. "I remain committed to working to protect our communities from the harms of illegal and unregulated e-cigarettes and will continue to hold companies accountable for targeting youth with their addictive products."

Raoul filed a lawsuit in January 2025 as part of a coordinated, bipartisan nationwide effort to hold companies accountable for unlawfully manufacturing, distributing, selling and marketing flavored disposable e-cigarette products. Raoul's lawsuit alleged that Posh products are not lawful for sale in Illinois under the Youth Prevention Vaping Act, which prohibits the sale of e-cigarettes unless they have been approved by the Food and Drug Administration (FDA) for marketing and sale in the U.S. The lawsuit also highlighted that the company marketed their products in countless fruit and candy flavors like Gummy Bear Ice, Ice Cream Cone and Jelly Berry on social media platforms popular with youth, such as Instagram, using imagery and themes attractive to young people.

The settlement requires the defendants to pay $20 million that will allow for the continued enforcement of state law protecting Illinoisans, including against illicit vaping entities. In addition, the entities are prohibited from selling, distributing or advertising Posh e-cigarettes in Illinois unless and until their products obtain a marketing-granted order from the FDA. Every new tobacco product, including e-cigarettes, must receive an order from the FDA authorizing its marketing and sale in the U.S.

The entities are also prohibited from advertising or marketing any e-cigarette in a way that is attractive to youth - specifically by using any cartoons, social media influencers or any model under the age of 35 - and must use all platform-provided age gating tools on any social media accounts where e-cigarettes are advertised or marketed.

Today's settlement announcement is part of Attorney General Raoul's ongoing work to combat youth e-cigarette use and hold e-cigarette manufacturers accountable for epidemic usage levels among youth and teens. After Raoul and a bipartisan coalition of 25 attorneys general urged Shopify Inc. to take stronger action against merchants that use its services to sell illegal tobacco products, Shopify announced a ban on the sale of all vaping products - including e-cigarettes - in June.

In May, Raoul and a bipartisan coalition called upon the FDA to abandon draft guidance that would ease approvals for flavored e-cigarette products, widely understood to disproportionately worsen youth addiction. In April, Raoul joined a bipartisan coalition urging major credit card companies and payment processors to take stronger action to prevent their payment networks from being used to facilitate sales of illegal vaping products.
