Keeping It Game-Day Safe and Legal: Ohio Department of Commerce Reminds Tailgaters of Alcohol, Cannabis Laws

COLUMBUS, Ohio - As Ohioans gear up for the Big Ten football conference home opener this Saturday, the Ohio Department of Commerce is calling on fans to celebrate responsibly, because game day safety is just as important as the final score. The Divisions of Liquor Control and Cannabis Control are reminding fans about what is legal and what's not when tailgating during pre-game festivities, especially as it relates to the consumption of alcohol and use of cannabis.<_o3a_p>

Tailgaters should always comply with Ohio's underage drinking and open container laws. Individuals under 21 are prohibited from consuming alcohol, and it is illegal to consume alcohol in public spaces unless it is within the boundaries of a liquor permit holder's premises or an active Designated Outdoor Refreshment Area (DORA). Individuals convicted of selling or providing alcohol to those under the age of 21 can face a maximum sentence of six months in jail and/or a $1,000 fine for each offense. <_o3a_p>

Similarly, the use of non-medical cannabis in public spaces is a minor misdemeanor in Ohio, and state law prohibiting smoking or vaping in public indoor spaces also applies to cannabis. Like alcohol, use of non-medical cannabis by individuals under the age of 21 is prohibited, and individuals who provide cannabis to minors can potentially face fines as well as possible jail time. According to the Centers for Disease Control and Prevention, tetrahydrocannabinol (THC) can adversely affect developing brains, which continue maturing until the age of 25. Preventing access to cannabis products by children and teens is critical in protecting their safety and health.<_o3a_p>

It is illegal to operate a vehicle while under the influence of either cannabis or alcohol.<_o3a_p>

Prior to gameday, individuals should always make sure to review any policies regarding alcohol and cannabis that may impact the tailgating location.<_o3a_p>

"We want every Ohioan enjoying a tailgate to do so responsibly and with safety in mind," Division of Liquor Control Superintendent Jackie DeGenova said. "We also remind our permit holders to uphold their responsibility to protect their customers and communities."<_o3a_p>

"We encourage individuals who choose to use non-medical cannabis to do so with safety in mind, both for themselves and those around them," said Division of Cannabis Control Superintendent Jim Canepa. "Before someone uses a cannabis product, it's critical they understand state law as it relates to public cannabis use and follow any policies that may be in place depending on where they're tailgating. It is also important to remember that federal law prohibits crossing state lines with marijuana. Your respect and adherence to these laws and policies will help to ensure everyone's safety and well-being."<_o3a_p>

Adults who consume alcohol are urged to drink plenty of water, eat beforehand, and make sure to plan an alternative ride home after the game by designating a driver, utilizing a rideshare service, or taking advantage of public transportation.<_o3a_p>

Liquor permit holders are reminded of their obligation to avoid serving underage individuals or anyone already intoxicated. Checking IDs at the point of sale remains critical. Additionally, under the Ohio Administrative Code, permit holders must not tolerate the use of controlled substances, including cannabis, on or near their premises.<_o3a_p>

Tailgating is a time-honored tradition in Ohio, and the Department of Commerce wants to ensure it remains a safe and enjoyable experience for everyone. By following these guidelines, fans can focus on what matters most: cheering on their team.<_o3a_p>
