Polish National Charged with Unlawfully Voting as an Alien

HONOLULU - United States Attorney Ken Sorenson announced that Polish national Dawid Nalepa, 45, was charged yesterday by Information with unlawfully voting as an alien.

Nalepa came to the United States in or around 2020 through the Visa Waiver Program, which he overstayed before applying for permanent resident status. According to court records, Nalepa was not a United States citizen when he cast a vote in the November 2024 general election. Nalepa understood he was not a citizen at the time he cast his ballot.

If convicted, Nalepa faces up to one year in prison, a fine of up to $100,000, and a term of supervised release.

The charge in the Information is merely an accusation, and the defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law. In the case of conviction, any sentence would be imposed by a United States District Judge based on the statutory sentencing factors and the advisory United States Sentencing Guidelines.

Homeland Security Investigations is investigating the case.

Assistant U.S. Attorney Arisa Herman is prosecuting the case.
