CMS Rescinds ‘Fast Track’ Review of Section 1115 Demonstration Extensions

In a July 7 informational bulletin, the Center for Medicaid and CHIP Services (CMCS) rescinded guidance allowing the Centers for Medicare & Medicaid Services (CMS) to quickly review and approve Section 1115 demonstration extensions.

CMCS granted this expedited approval, which applied to extensions and simplifications of certain demonstrations, in a July 24, 2015, informational bulletin. However, the Working Families Tax Cut legislation made significant changes to requirements for Section 1115 demonstrations. The 2015 guidance is rescinded so CMS can ensure compliance with the new requirements and allow enough time for the CMS Chief Actuary to certify budget neutrality for demonstrations.
