WASHINGTON, D.C. - U.S. Representative Emilia Sykes (OH-13) today called for urgent action to ensure businesses receive refunds following the Supreme Court's ruling striking down tariffs imposed under the International Emergency Economic Powers Act (IEEPA).
In February, the Court ruled that the Trump Administration lacked authority under IEEPA to impose sweeping tariffs announced in April 2025, requiring the federal government to return more than $166 billion collected from importers.
"Ohio businesses were forced to shoulder the cost of illegal tariffs, and they deserve their money back, quickly and transparently," said Rep. Sykes. "This rollout must be efficient, accessible, and fair. I will continue working to make sure our small businesses aren't left behind in the process. However, while businesses now have a pathway to recover losses, American families are still paying higher prices caused by these tariffs. We cannot ignore the impact on everyday Americans."
On Monday, U.S. Customs and Border Protection launched a new system-the Consolidated Administration and Processing of Entries (CAPE) portal-within the Automated Commercial Environment (ACE) to allow importers to request refunds for tariffs paid under the International Emergency Economic Powers Act (IEEPA). CBP estimates that valid claims will be processed within 60 to 90 days.
To apply, businesses and importers must:
Create an ACE Portal Importer Account
Enroll in ACH refunds
Submit CAPE declarations through the portal
