Potential breaches of EU legislation in the management of e-scooter waste

As more and more electric scooters are discarded in the Member States, serious shortcomings in the implementation of EU waste legislation have come to light. The equipment concerned is, as a rule, subject to Directive 2012/19/EU (WEEE), which in its Article 12 et seq. places an obligation on 'producers' to finance and organise the separate collection, proper treatment and recycling of waste. At the same time, Article 35 of Directive 2008/98/EC requires records to be preserved and waste streams to be adequately documented. There is, however, evidence of poor registration and inadequate monitoring of discarded e-scooters by the obliged entities.

LMT batteries fall under Regulation (EU) 2023/1542, which sets out binding requirements for traceability, technical documentation, labelling and a digital battery register. Compliance with these obligations has not been fully clarified.

Meanwhile, there have been reports that discarded e-scooters or batteries are being exported to non-EU countries as 'repairable products', which may constitute circumvention of Regulation (EC) No 1013/2006 on shipments of waste.

Can the Commission answer the following:

  • 1.How does it assess the obliged entities' compliance with the above legislative obligations?
  • 2.Does it consider it necessary to establish a single European traceability mechanism?
  • 3.What measures does it intend to take to prevent illegal cross-border shipments of such waste?
