ACC Statement on Applications for Rehearing re: TEP Energy Supply Agreement

Phoenix, Ariz. - The applications for rehearing on Docket No. E-01933A-25-0187 are all deemed automatically denied because no action was taken by the Commission within the 20-day statutory period. The Commission Decision therefore stands without revision. The process for evaluating and approving the Tucson Electric Power Company's (TEP) Energy Supply Agreement (ESA) with Beale Infrastructure Group at its December 3, 2025, Open Meeting (Decision No. 81587) is the same procedure that has been implemented over the years to evaluate such applications.

ACC Staff found that the ESA would have no adverse impacts on system reliability and may even improve reliability. Staff also found that there would be no cost-shift to other customers, and further information showed that the high-load customer's resource additions to the grid will ultimately lower fixed costs for most residential customers. Staff concluded the ESA provides extra customer protections, such as minimum monthly billing requirements and termination penalties supported by financial security.
