Superior Court Issues Preliminary Injunction Against AG for Illegal “Dignity Project” Contract Signed Without Governor’s Approval

Hagåtña, Guam - The Superior Court of Guam today granted Governor Lou Leon Guerrero's Motion for a Preliminary Injunction, blocking Attorney General Doug Moylan and the Office of the Attorney General from performing on the OAG's April 15, 2025 Contract for hotel services for the Dignity Project, worth over One Million Dollars ($1M) in public funds. In its 28-page decision, issued only days after the parties argued closing arguments, the Court found that the Governor was likely to succeed on the merits of her claim, that the OAG violated Guam law by failing to obtain the Governor's approval on the contract, which was subject to centralized accounting by the Department of Administration.

The Court also found it is likely the OAG violated Guam procurement law on sole source procurements because the Attorney General was not authorized to procure the services in the contract, and did not meet the strict requirements of the law for such procurements. Because the OAG likely violated these statutes, the Court also held that the Governor demonstrated irreparable harm. The Court held, "the expenditure of this large sum required a careful and lawful procurement and approval, and that just did not occur in this case."

"The Attorney General has gone unchecked for far too long, spending enormous sums of money without regard for the law," said Governor Leon Guerrero. "Today's decision validates that the Attorney General is not above the law and that he must comply with the law the same way every other agency in our government does."

"This Attorney General is so quick to point out the shortcomings of our government agencies, even though the law requires him to help our agencies. Meanwhile, he has run amok, drunk with power and self-interest," added Adelup Director of Communications Krystal Paco-San Agustin. "If the AG wants to hold people accountable for violating the law, he should start by taking a good, hard look in the mirror."

A status hearing in the matter is scheduled for July 23, 2025 at 3:00 p.m. to discuss further scheduling.
