Public Notice: State Certification of Proposed U.S. Army Corps of Engineers Nationwide Permits

The Wyoming Department of Environmental Quality (WDEQ) has received a request from the U.S. Army Corps of Engineers (USACE) for water quality certification pursuant to Section 401 of the federal Clean Water Act. The USACE proposes to reissue 56 existing and one new Nationwide Permit (NWPs). Proposed NWPs can be reviewed at https://www.usace.army.mil/Missions/Civil-Works/Regulatory-Program-and-Permits/Nationwide-Permits/

NWPs are used to authorize discharges of dredged or fill material into waters of the United States under Section 404 of the federal Clean Water Act and Section 10 of the federal Rivers and Harbors Act for categories of activities that have minimal individual and cumulative adverse environmental effects. The WDEQ is soliciting comments to inform its decision on certifying the proposed NWPs.

Requests for information about certifying USACE's proposed NWPs should be directed to James Tarzon by email ([email protected]) or phone (307-777-6701). Written feedback must be addressed to James Tarzon, Wyoming DEQ/WQD, 200 W. 17th Street - 4th Floor, Cheyenne, WY, 82002, and be postmarked on or before 5:00 p.m. on Nov. 17, 2025 to be considered. Electronic comments may only be submitted through and accepted by the Wyoming DEQ comment portal provided at https://http://wq.wyomingdeq.commentinput.com/. Phone comments will not be accepted.
