Court Issues Temporary Restraining Order on AG’s Illegal Million Dollar Sole Source Contract

Hagåtña, Guam - Superior Court Judge John Terlaje today issued an order from the bench granting Governor Leon Guerrero's Motion for a Temporary Restraining Order, restraining Attorney General Doug Moylan and the Office of the Attorney General from performing, incurring debt on, or paying on the April 15th contract signed by AG Moylan and the Tropical Palm Hotel, which the Attorney General executed without the Governor's approval. The contract, which the Attorney General procured using a noncompliant "sole source" procurement, obligates $1,131,500 in opioid recovery funds. Governor Leon Guerrero filed her action two days after the AG's office threatened a Department of Administration official with criminal prosecution if they did not register the contract.

"While I agree that we must all do more to help our island's homeless population, it is important that we accomplish this task lawfully. The Attorney General has demonstrated a pattern for disregarding the laws that stand between him and his goals," said Governor Leon Guerrero. "I am grateful that the Court put a temporary stop to this most recent violation while we continue the fight for longer term relief."

Judge Terlaje, who is presiding over a murder trial today, intends to issue a written order promptly. The matter is scheduled for a hearing on the Governor's motion for a preliminary injunction on May 8, 2025 at 9:00 a.m.

The Attorney General indicated he would appeal today's decision to the Guam Supreme Court.
