Members review potential deliverables on special and differential treatment in MC14 run-up

At a meeting of the Committee on Trade and Development in Special Session (CTD SS) on 5 December, members considered two new G-90 proposals concerning implementation of special and differential treatment (S&DT) provisions in WTO's Agreements on Sanitary and Phytosanitary Measures (SPS) and Technical Barriers to Trade (TBT). They also discussed a list of possible incentives to guide reporting under Article 66.2 of the Trade-related Aspects of Intellectual Property Rights (TRIPS) Agreement and reviewed next steps in Committee work ahead of the 14th Ministerial Conference (MC14) and beyond.

Since its last meeting held on 22 May 2025, the Committee�has advanced its work through evidence-based discussions, informal thematic sessions and strengthened collaboration with relevant technical committees. In her report to the Committee, Chairperson Ambassador Kadra Ahmed Hassan of Djibouti highlighted that an informal thematic session on technology transfer was held on 12 June 2025 under the aegis of the CTD SS in collaboration with the Council for TRIPS, as well as two thematic sessions on S&DT held on 24 Juneand 30 September2025 under the aegis of the TBT and SPS Committees in cooperation with the CTD SS.

Insights and�key takeawaysfrom these thematic sessions have provided useful information for members and the respective WTO bodies as they explore practical solutions to address needs and challenges faced by members in implementing S&DT provisions. Mr. Daniel Lim of Singapore, the CTD SS Facilitator for SPS and TBT, underscored the importance of synergies between the CTD SS and the SPS and TBT committees. These collaborative efforts have facilitated members' engagement and contributed to delivering on the mandate of the MC13 Ministerial Declarationon the Precise, Effective and Operational Implementation of S&DT Provisions of the SPS and TBT Agreements.

C�te d'Ivoire, speaking on behalf of the G-90, presented a new G-90 communication containing specific recommendations to enhance the implementation of S&DT provisions in the SPS and TBT agreements, including transparency and notification of extension of comment periods for new measures and enhancing coordination of technical assistance. �

Bangladesh, on behalf of the G-90, introduced a possible illustrative list of voluntary, non-binding incentives that developed members can provide to enterprises and institutions in their territories to promote technology transfer to least-developed countries (LDCs)�under TRIPS Article 66.2. The list includes examples of traditional and innovative approaches to technology transfer intended to support LDCs in building a sound and viable technological base. Members exchanged preliminary views on next steps, including furthering the discussion of the proposed illustrative list at the Council for TRIPS.�

Members continued to engage in S&DT negotiations in a pragmatic and targeted way, with a view to addressing specific needs and challenges of developing members, including LDCs. Members also recognized the value of cross-committee collaboration and evidence-based discussions in strengthening S&DT implementation. Progress in the areas of SPS, TBT and TRIPS Article 66.2 was noted as a positive contribution to the development outcomes expected for MC14. The remaining G-90 Agreement-specific proposals will be addressed after MC14.
