Court Reverses Mega Beverage Redemption Center v. City of Mount Vernon, Orders New Trial

Mount Vernon, June 4, 2025 - The City of Mount Vernon's Law Department and Comptroller are pleased to announce a significant legal development following a critical decision by the Appellate Division: Second Judicial Department, which reversed a prior ruling in the case of Mega Beverage Redemption Center vs. City of Mount Vernon and ordered a new trial.

"This outcome represents a meaningful step forward in our ongoing pursuit of justice and fairness for the taxpayers of Mount Vernon," said Corporation Counsel Brian G. Johnson. "We commend the diligence and integrity of our legal team, whose unwavering commitment to the rule of law helped bring about this critical reversal."

On September 20, 2016, the plaintiff, the operator owner of a beverage container recycling business, commenced this action against the City, alleging various civil rights claims involving various former city officials, and its reversal underscores the importance of strong advocacy and procedural integrity in our judicial system.

"We are grateful for the Court's decision, which represents a significant victory for the taxpayers of Mount Vernon. Had our appeal been denied, the financial impact would have been severe -potentially triggering a 5.2% tax increase or requiring the City to issue a Bond Anticipation Note (BAN) at current market interest rates. This outcome protects our residents from unnecessary financial burden and reinforces our commitment to sound fiscal management," said Darren M. Morton, Comptroller.
