SIIA Files Amicus Briefs Defending Section 230 in App Store Litigation

SIIA has filed amicus briefs in two closely related Ninth Circuit appeals involving Apple, Google, and Meta, urging the court to reaffirm the broad protections of Section 230. The cases center on whether app store operators can be held liable for third-party content based on their role in processing in-app payments for "simulated casino-style" games.

In its briefs, SIIA argues that payment processing is an integral part of publishing digital content-not a separate commercial activity-and that imposing liability would effectively require platforms to monitor third-party content, undermining Section 230's core protections. The association warns that narrowing these protections would disrupt online commerce, threaten innovation, and expose a wide range of internet intermediaries to sweeping liability for third-party activity.
