A jury convicted Marvin Moyers of Level 3 felony criminal confinement while armed with a deadly weapon and Level 4 felony criminal confinement resulting in moderate bodily injury. Moyers appealed, arguing the convictions violated Indiana's prohibition against substantive double jeopardy. A majority of the Court of Appeals affirmed. Moyers v. State, 249 N.E.3d 667 (Ind. Ct. App. 2024), trans. pending. Moyers has petitioned the Indiana Supreme Court to assume jurisdiction over the appeal.
