TechNet, CCIA, ITI, and SIIA File Amicus Brief in Anthropic PBC v. U.S. Department of War

Washington, D.C. - Today, a broad coalition representing the technology sector and a significant portion of the U.S. economy filed an amicus brief in the Anthropic PBC v. U.S. Department of War, et al. lawsuit pending in the United States Court of Appeals for the District Of Columbia.

The brief, signed by TechNet, the Computer & Communications Industry Association (CCIA), the Information Technology Industry Council (ITI), and the Software & Information Industry Association (SIIA), outlines the immediate impacts of the Department of War's recent supply chain risk designation of a single company on America's broader technology sector, as well as the U.S. government's established contracting procedures and ability to access products and services.

The amici write in the brief that the Determination "elevates a contract dispute about commercial contracting terms to a supply-chain risk…that affects the entire industry, imperiling the commercial contracting practices on which the government and industry have relied for decades to deliver timely and modern solutions to the government." The brief also argues that the Determination threatens "the entire enterprise of federal procurement for the technology indus try by disregarding the carefully constructed legal structure that amici's members rely upon to make reasoned business decisions."

The organizations filing the brief collectively represent hundreds of technology companies, many of which contract with the U.S. government, including the Department of War, to provide mission-critical technology products and services, including AI.
