Gilead Statement on Agreement in Texas False Claims Act Matter

Foster City, Calif., October 22, 2026 - Gilead Sciences has reached an agreement to resolve litigation relating to the company's patient support programs, Texas ex rel. Health Choice Advocates v. Gilead Sciences, Inc. The case was brought by Health Choice Advocates, an entity formed to file lawsuits against pharmaceutical companies, and the State of Texas later joined it.

Gilead expressly denies the allegations and entered into this agreement to avoid the cost and distraction of prolonged litigation. Under the agreement, Gilead will make a payment to resolve the matter, resulting in dismissal of the case with prejudice and a release of all claims by the State of Texas and Health Choice Advocates. This settlement helps ensure that Texas patients can continue to access the Gilead medicines they rely on. Gilead will continue to make its patient support programs available to patients in Texas and across the United States.

Gilead's patient support programs are designed to help patients navigate access, coverage and appropriate use of its medicines, helping patients stay on the therapy their healthcare providers prescribe, particularly for complex and chronic conditions. Gilead believes these programs are lawful, appropriate, beneficial, and consistent with its commitment to patients. The company remains focused on advancing innovative therapies, meeting patient needs and upholding strong compliance standards.
