New Expedited Miscellaneous Hearing Docket Dates for Judge Berger

Beginning May 6, 2026, Judge Berger will hold a monthly Expedited Miscellaneous hearing docket to hear certain types of time-sensitive matters. It will generally be held on the first Wednesday of every month at 1:30 PM. The purpose of this docket is to provide a forum for Judge Berger to expeditiously handle certain relatively simple, time-sensitive matters.

Matters Eligible for Judge Berger's Expedited Miscellaneous Docket: Only the following matters are eligible:

Motions to extend stay (Chapter 7 and Chapter 13)
Debtor motions to sell (Chapter 13)
Debtor motions to incur credit (Chapter 13)
Debtor motions to substitute collateral (Chapter 13)
Debtor motions for turnover (Chapter 13)

Other matters may be set for this docket by request only if the court enters an order granting permission, but such requests are disfavored.

Note: All of these matters are still eligible to be set to a regular court docket.

Matters NOT Eligible for Judge Berger's Expedited Miscellaneous Docket: Do not set anything to the Expedited Miscellaneous Docket unless it is one of the eligible matters listed above. Examples of matters that must not be set to the Expedited Miscellaneous Docket are: motions to dismiss, motions for relief from stay, claim objections, and Chapter 11 matters (which will generally be handled on an ad hoc basis).

The dates for the Expedited Miscellaneous Docket in 2026 are:

May 6 at 1:30 PM
June 3 at 1:30 PM
July 1 at 1:30 PM
August 5 at 1:30 PM
September 2 at 1:30 PM
September 30 at 1:30 PM
November 4 at 1:30 PM
December 2 at 1:30 PM

Judge Berger's hearing calendars (available at https://www.ksb.uscourts.gov/calendars-dockets) have been updated to include these dockets.
