WDE Seeks Public Comment on Application for Federal Ed-Flex Waiver Authority

CHEYENNE - The Wyoming Department of Education (WDE) is seeking public comment on an application to the U.S. Department of Education for Education Flexibility (Ed-Flex) authority under the Education Flexibility Partnership Act.

If approved, Ed-Flex status will grant the WDE authority to directly waive certain federal statutory or regulatory requirements for key Elementary and Secondary Education Act (ESEA) state-administered formula grant programs serving local educational agencies and schools. By enabling state-level waiver approval, the WDE eliminates the need for districts to submit individual requests to the U.S. Department of Education, thereby reducing administrative burdens and allowing for more targeted local programming.

Ed-Flex authority enables the WDE to grant state-level waivers for local requirements under the following programs:

• Title I, Part A: Improving Basic Programs Operated by Local Educational Agencies.
• Title I, Part D: Prevention and Intervention Programs for Children and Youth Who Are Neglected, Delinquent, or At-Risk.
• Title II, Part A: Supporting Effective Instruction.
• Title IV, Part A: Student Support and Academic Enrichment Grants.
• Carl D. Perkins Career and Technical Education Act.

Exclusions: Ed-Flex authority does not permit waivers of requirements related to civil rights, health and safety, parental involvement, or the Individuals with Disabilities Education Act (IDEA).
