Cutler Legislation to Encourage Donation of Unused Prescription Drugs Awaits Governor’s Signature into Law

October 21, 2026

HARRISBURG - Efforts by state Rep. Bryan Cutler (R-Peach Bottom) to address unnecessary disposal of prescription medications that still have health benefits has passed both chambers of the General Assembly and now sits with Gov. Josh Shapiro.

"This legislation was inspired by a constituent, Mr. Hess, who came to me years ago with a large container of unused cancer-related medications that belonged to his wife, who'd passed away. It mirrors that of 44 other states and I'm glad we were finally able to get it across the finish line in the House and Senate and onto the governor's desk," said Cutler. "We are presently disposing of and wasting prescription medications that still have a shelf life and could improve the quality of life for someone who cannot afford them. The governor's signature will change that."

House Bill 69 would establish a program that allows unused prescription drugs to be re-dispensed to patients who are indigent by approved pharmacies that choose to participate. The legislation includes safeguards for donated medications and doesn't include the dispensing of controlled substances.

"For the record, any patient wanting to dispose of an unwanted or unused controlled substance is required to contact local law enforcement," Cutler added. "The Prescription Drug Repository Program is simply an expansion of an existing program (the Cancer Drug Repository Program) and confined to medications that are donated to local, participating pharmacies by both health care facilities and individuals."
