Attorney General Weiser voids unfair MV Realty contracts, saves Colorado homeowners $8.4 million

March 24, 2026 (DENVER) - Attorney General Phil Weiser today announced an agreement with MV Realty that voids unfair long-term real estate agreements, clears homeowners' property titles, and delivers $600,000 in consumer restitution while saving Colorado homeowners an estimated $8.4 million.

"MV Realty's practices illegally locked Colorado homeowners into unfair, long-term contracts tied to their homes, putting their financial security at risk," said Attorney General Weiser. "A home is often a family's most important asset, and no one should be trapped in an agreement like this. We took action to hold MV Realty accountable, cancel these contracts, and protect homeowners across Colorado."

The agreement pending court approval resolves the attorney general's 2025 lawsuit alleging that the company illegally locked hundreds of Colorado homeowners into unfair brokerage contracts with exorbitant fees and decades-long terms that even applied to their heirs.

In October 2025, the attorney general secured a court order requiring MV Realty to remove claims it had placed on homeowners' property titles. This agreement makes those protections permanent.

Under the consent judgment, all MV Realty's "Homeowner Benefit Agreement" contracts with Colorado consumers are void and unenforceable, and the company is permanently barred from collecting any related fees or payments. Based on evidence obtained during the litigation, Attorney General Weiser estimates that MV could have collected an additional $8.4 million from Colorado consumers had these contracts remained in place.

MV Realty must terminate all documents recorded against homeowners' properties and fully release any claim or interest in those homes at no cost to consumers. The company is required to take these actions within strict timelines, notify affected homeowners that their property titles have been cleared, and dismiss any pending legal claims based on these agreements.

As part of the resolution, MV Realty will pay $600,000 to Colorado for consumer restitution and education efforts, with payments made over the next year. The agreement also includes $450,000 in civil penalties and $50,000 in attorneys' fees, which are suspended so long as the company complies with the terms of the agreement and pays the required restitution. The settlement also prohibits MV Realty from performing real estate brokerage services in Colorado going forward.

The agreement settles Colorado's claims without admission of wrongdoing and avoids prolonged litigation, while preserving the attorney general's authority to enforce the agreement and take action against any future violations of Colorado law.
