SIIA Raises First Amendment Concerns with Oregon SB 1587

The Software & Information Industry Association (SIIA) submitted testimony to the Oregon Legislature outlining serious constitutional and practical concerns with SB 1587, a bill regulating the dissemination of brokered personal data. While SIIA strongly supports meaningful consumer privacy protections, the association emphasizes that such protections must be carefully balanced against First Amendment-protected speech and other core societal interests.

As written, SB 1587 would impose sweeping restrictions on the sharing of publicly available information, rely on vague and content-based standards, and single out certain speakers-raising significant constitutional red flags. SIIA also warns that the bill could unintentionally harm Oregonians by limiting access to data relied upon for fraud prevention, identity theft protection, and enforcement of civil laws. SIIA urges lawmakers to consider targeted revisions and welcomes continued dialogue to address these concerns.
