Albany County District Attorney Lee C. Kindlon announced today that a 37-year-old Albany man who was found passed out in the driver's seat of his car with a gun in his hand has admitted his guilt.
Eric Gamble pleaded guilty to Criminal Possession of a Weapon in the Second Degree Tuesday in front of the Honorable William Little.
On Oct. 25 at 1:12 a.m., an Albany Police officer found Gamble slumped over the wheel of his 2015 black Infinity, which was parked in the middle of Grand Street facing south at the intersection of Madison Avenue.
The car was running and Gamble had a loaded Smith & Wesson 9mm in his hand, with one round in the chamber and three in the magazine.
The officer ordered Gamble out of the vehicle but he sped off on Grand Street and struck two vehicles parked along the road. He continued up Morton Avenue before Albany Police were able to take him into custody near Avondale Terrace and Catherine Street.
Gamble was on probation and charged with gun possession charges, DWI, and multiple vehicle and traffic violations.
Gamble was remanded to the custody of the Albany County Correctional Facility and will be sentenced on Feb. 6, when he is set to receive five years in state prison followed by five years of post-release supervision.
Assistant District Attorney Marissa Olsen of the Street Crimes Unit is prosecuting the case.
