ILR: Dismissal of Baltimore’s Baseless Public Nuisance Lawsuit Over Single-Use Plastics Is a Welcome Victory

WASHINGTON - The U.S. Chamber of Commerce Institute for Legal Reform (ILR) today issued a statement of support for the recent order dismissing with prejudice the public nuisance lawsuit filed by the Mayor and City Council of Baltimore against PepsiCo and Coca-Cola over plastic pollution.

"Questions of public policy are properly addressed by legislatures and regulatory agencies, not the courts. This ruling makes that principle crystal clear," said ILR President Stephen Waguespack. "Judge Carrion correctly recognized that Maryland law should not be stretched to impose liability on companies for selling lawful products."

ILR will continue to watch developments in public nuisance litigation across the country, advocate for legislation that protects lawful products and conduct, and champion a legal system that demands real claims and real causation.
