District Court Oversteps in Amazon Prime Litigation

This statement can be attributed to Chris Mohr, President, Software & Information Industry Association (SIIA):

SIIA is concerned by the decision of a federal district court judge finding partial summary judgment for the Federal Trade Commission against Amazon regarding its Prime membership service. Particularly troubling is the court's holding that two individuals could be personally liable for a corporate violation of the FTC Act without a showing that they knew the conduct in question was unlawful. This holding is contrary to controlling precedent and, if upheld, would have a chilling effect on innovation. Other aspects of the court's decision are likely to generate customer confusion, for example, by requiring customers to reenter billing information despite providing consent before any billing information is used.
