Dentons is pleased to announce that it has secured an appellate victory on behalf of the New York County Lawyers Association (NYCLA) in an employment discrimination and retaliation lawsuit, Heidi Leibowitz v. New York County Lawyers Association.
The Appellate Division, Second Department, affirmed the trial court's grant of summary judgment in favor of NYCLA, dismissing all claims brought by the plaintiff, who alleged discrimination based on pregnancy and gender, as well as retaliation after the plaintiff's position was changed from full-time to part-time and her employment was terminated following a pregnancy-related leave of absence. The court concluded that NYCLA established legitimate, nondiscriminatory and nonretaliatory reasons for its actions and that the plaintiff failed to present sufficient evidence that those reasons were a pretext for unlawful discrimination or retaliation. This ruling highlights Dentons experience defending employers against complex discrimination and retaliation claims under New York law.
