This opinion considers the effects of removing two existing dolphins, in-water pile driving of steel piles (vibratory, impact, and down-the-hole), construction vessel traffic, and support operations.

This opinion considers the effects of removing two existing dolphins, in-water pile driving of steel piles (vibratory, impact, and down-the-hole), construction vessel traffic, and support operations.

The action may affect the threatened Mexico Distinct Population Segment (DPS) humpback whale, endangered Western North Pacific DPS humpback whale, and endangered western DPS Steller sea lion.

This biological opinion is based on information provided in the March 2026 Biological Assessment submitted by the USACE's non-federal representative Owl Ridge Natural Resource Consultants, Inc., the IHA Application, and Proposed IHA (91 FR 23065, April 29, 2026). Other sources of information relied upon include consultation communications (emails and virtual meetings), recent consultations completed in the same region, previous monitoring reports, and marine mammal surveys conducted in and around Berners Bay, Alaska. A complete record of this consultation is on file at NMFS's Alaska Region office.
