Concord, NH - Attorney General John M. Formella announces that Nathaniel Kay, age 42, of Belmont, New Hampshire, has been indicted by the Belknap County Grand Jury on one class B felony count of second-degree assault and two class B felony counts of criminal restraint. The indictments allege that Mr. Kay committed these offenses on October 14, 2025, against his elderly mother, V.W.K., and his elderly father, R.K.
The second-degree assault indictment alleges that Mr. Kay recklessly caused serious bodily injury, a traumatic brain injury, to V.W.K., by striking her in the head.
The criminal restraint indictments allege that Mr. Kay knowingly and unlawfully confined V.W.K. and R.K. with a rope under circumstances exposing them to a risk of serious bodily injury.
Mr. Kay has also been charged by information with three class A misdemeanor charges of simple assault. These charges allege that, on October 14, 2025, Mr. Kay knowingly caused unprivileged physical contact to V.W.K. by pushing her, and to R.K. by pushing him and striking him in the head.
Class B felonies are punishable by up to 3 ½ to 7 years in the New Hampshire State Prison and a fine of up to $4,000.00. Class A misdemeanors are punishable by up to 12 months in the House of Corrections and a fine of up to $2,000.00.
The charges and allegations against Mr. Kay are merely accusations, and he is presumed innocent unless and until proven guilty.
An arraignment is scheduled in Belknap County Superior Court on February 27, 2026, at 8:30 a.m.
This matter is being investigated by the New Hampshire State Police Major Crimes Unit and the Belmont Police Department. The case is being prosecuted by Senior Assistant Attorney General Bryan J. Townsend, II, and Assistant Attorney General Nancy A. DeAngelis, both of the Attorney General's Elder Abuse and Financial Exploitation Unit.
