The Department of Housing and Urban Development (HUD) On February 26, 2026 announced plans to revoke eviction notification requirements that LeadingAge had supported.

In an interim final rule, which will take effect on March 20 while the agency continues to accept public comments, the agency revokes a Biden-era policy requiring HUD-assisted housing providers to notify tenants 30 days prior to an eviction related to non-payment of rent. The U.S. Department of Agriculture (USDA), which administers the Rural Housing Service, issued a similar rescission on February 25.

LeadingAge had supported the notification requirements as an avenue to improving housing stability among HUD-assisted older adult households. We will work with our membership on comments that express our opposition to the requirements' revocation.

The previous requirements applied to both Public Housing Agencies (PHAs) and owners of HUD-assisted Multifamily Housing properties, including project-based Section 8, Section 202 Project Rental Assistance Contracts (PRACs) and Senior Preservation Rental Assistance Contracts (SPRACs), seeking to address what was previously a patchwork of federal, state, and local requirements. Regardless of the revoked policy, most LeadingAge affordable senior housing provider members remain subject to a similar 30-day notification requirement.
