WASHINGTON - Yesterday, U.S. Senators Tommy Tuberville (R-AL) and Katie Britt (R-AL) introduced the Mandatory E-Verify Act of 2026 to permanently reauthorize the E-Verify program and require its use by all employers in the United States. The legislation is thelatest effort by Sen. Tuberville to crack down on incentives for illegal aliens.
E-Verify remains one of the most efficient and effective tools for verifying employment eligibility and cutting off a major incentive that drives illegal immigration to the United States. While E-Verify is already mandatory in certain states and federal agencies, there is no nationwide standard. The Mandatory E-Verify Act would enhance civil and criminal penalties for employing illegal aliens, strengthen fraud prevention measures within the E-Verify program, and prohibit states from blocking or preventing employers from using E-Verify.
"American jobs should be going to Americans," said Sen. Tuberville. "The Trump Administration is working overtime to deport millions of criminals who came here illegally during the Biden administration, but we also need to remove the incentives that are encouraging illegals to invade our country. E-Verify is a proven tool that protects good-paying jobs for Americans and helps employers legally staff their businesses. It's past time we are serious about enforcing all of our country's immigration laws, especially when it comes to workforce participation. This bill is a win for small businesses, American workers, and the rule of law."
Joining Sens. Tuberville and Britt in introducing the Mandatory E-Verify Act are Sens. Marsha Blackburn (R-TN), Ted Budd (R-NC), Shelley Moore Capito (R-WV), Tom Cotton (R-AR), Ted Cruz (R-TX), Lindsey Graham (R-SC), Cindy Hyde-Smith (R-MS), and James Lankford (R-OK).
