District court rules in favor of Tennessee’s 340B contract pharmacy law

The U.S. District Court for the Middle District of Tennessee June 30 denied a motion for a preliminary injunction by AbbVie in its lawsuit against the state's law on 340B pricing for contract pharmacy arrangements. The Tennessee law prohibits drug companies from denying hospitals the same 340B discounts for drugs dispensed at community pharmacies that would be provided via in-house pharmacies. The AHA June 4 filed an amicus brief in the case that defends the state law. AbbVie claims the state law is unconstitutional.
