NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by Macomb County.

REQUEST FOR RELEASE OF FUNDS

On or about 5/22/2026, Macomb County will submit a request to the US Department of Housing and Urban Development's (HUD) Detroit Field office for the release of Community Development Block Grant (CDBG) funds and HOME Investment Partnership Program (HOME) under Title 1 of the Housing and Community Development Act of 1974 (PL 93-383) and under Title 2 of the National Affordable Housing Act of 1990 (42 U.S.C. 12701 et seq.), to undertake the following projects:

Housing Rehabilitation Program - Funding will be used for no-interest, deferred loans and grants to rehabilitate homes owned by low-to-moderate income households.

For this project, exact locations are yet to be determined. This is therefore a tiered review. The Tier I review, now available to the public, summarizes the purpose and need for the project and explains how the project will generally meet environmental requirements. Tier II reviews are conducted once individual sites have been identified. They provide more details about the environmental circumstances of the project at each specific location, including nearby potential noise hazards, toxic substances, flood plains or historic preservation considerations.

Acquisition/ Rehab/ Disposition- Funding will be provided to housing developers to acquire and/or rehabilitate properties for resale and/or rent to low-to-moderate income families throughout the Macomb HOME Consortium's jurisdiction. They will be single family homes.

FINDING OF NO SIGNIFICANT IMPACT

The two activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements: the Housing Rehabilitation Program and Acquisition/Rehab/Disposition Program. PUBLIC COMMENTS

Questions regarding the ERR can be directed to Associate Planner, Brittany Mohr by phone at 586-466-6179. Any individual, group, or agency may submit written comments regarding the ERR by email to [email protected]. All comments received by 5/21/2026, will be considered by Macomb County Planning & Economic Development, prior to authorizing the submission of a request for release of funds. Comments should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION

Macomb County Planning & Economic Development certifies to HUD that John Paul Rea on behalf of County Executive Mark Hackel, in his capacity as Deputy County Executive consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows Macomb County to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of funds and Macomb County's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of Macomb County; (b) Macomb County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the U.S. Department of Housing and Urban Development Detroit Field Office, Keith E. Hernandez, Director, Community Planning and Development at [email protected]. Potential objectors should contact HUD to verify the actual last day of the objection period.
