The Malta Financial Services Authority ("MFSA" or the "Authority") refers to its public notice issued on 30 July 2026 concerning an entity operating under the name of DistributeX and other similar variations (the "Entity") (https://www.mfsa.mt/news-item/mfsa-notice-distributex-distributex-distributex-limited-dx-distribute-or-dx/).
The Authority has become aware of a communication dated 12 August 2026, entitled "DistributeX Official Announcement", which appears to have been circulated by the Entity to its members. The communication makes a number of statements concerning the MFSA and, in particular, claims that the Entity entered into discussions with the MFSA regarding its activities. The communication further claims that the MFSA advised the Entity that it must comply with the EU Markets in Crypto-Assets Regulation ("MiCA") and applicable anti-money laundering requirements.
The MFSA wishes to clarify that these statements, insofar as they suggest that DistributeX has engaged in regulatory discussions with the Authority or has received regulatory guidance or instructions from the MFSA concerning the continuation or regularisation of its activities, are incorrect. The MFSA has not entered into any such discussions with DistributeX and has not provided the Entity with the regulatory advice or instructions described in the communication.
In particular, members of the public should not interpret the communication circulated by DistributeX as indicating that the Entity is engaging with, cooperating with, or taking steps agreed with the MFSA to regularise its activities. Nor should the communication be interpreted as indicating that the MFSA has endorsed, approved or otherwise accepted any compliance measures purportedly being implemented by the Entity.
The Authority further notes that the communication instructs European users to transfer 300 EURC to a designated DistributeX account as part of what the Entity describes as an "on-chain address interaction and fund-receiving capability verification" process. Members of the public are strongly advised to exercise extreme caution before transferring any additional funds to the Entity in response to this or similar requests.
The MFSA reiterates the contents of its notice of 30 July 2026 and confirms that DistributeX, distributex, DistributeX Limited, DX Distribute or DX, and any individuals, representatives or promoter groups operating under these names, are not, and have never been, licensed, authorised, regulated or otherwise approved by the MFSA. Accordingly, they are not permitted to provide financial services or undertake any activity requiring authorisation under Maltese financial services legislation.
The Authority therefore strongly cautions members of the public against relying on statements or representations which may create the impression that DistributeX is authorised by, operating with the approval of, or otherwise working with the MFSA.
The MFSA would like to remind consumers of financial services not to enter into any financial services transaction unless they have ascertained that the entity with whom the transaction is being made is authorised to provide such services by the MFSA or another reputable financial services regulator. Financial regulations oblige licensed businesses to comply with strict legal requirements in the interest of investors and the markets. The activities of unlicensed entities are unregulated, making transactions with such entities risky for consumers.
In case of any losses incurred as a result of financial services transactions undertaken with unlicensed or unauthorised entities or individuals, a report may be filed with the Malta Police Force or the relevant law enforcement agency in your jurisdiction since this may be considered a criminal offence.
