BakerHostetler Earns Dismissal in CRH Healthcare Class Action

Partner Christopher Wiech led a team that included Associates Georgia Bennett and Savannah Avera as they helped CRH Healthcare defeat a class action in the U.S. District Court for the Northern District of Georgia. Plaintiff Jane Doe, et al., claimed six counts of misconduct, including negligence, breach of fiduciary duty, breach of implied contract, breach of express contract, unjust enrichment and violations of the Electronic Communications Privacy Act. The BakerHostetler team successfully argued a motion to dismiss, which was granted on all six counts (without prejudice).

CRH Healthcare runs health clinics and a website where patients can schedule medical appointments, locate treatment facilities, pay bills, search medical specialties and treatment options and obtain telehealth services. The plaintiff claimed that her personal information was transmitted to third parties, including Google, because CRH Healthcare installed certain web-based technologies on its website. In
dismissing all claims against CRH Healthcare, the judge wrote that the plaintiff's allegations failed to
explain what damages were actually suffered by the defendant's actions.
