Lifting the Moratorium on Shore Fishery Lease Applications in Nushagak Bay

The Southcentral Regional Land office (SCRO) is lifting the moratorium on shore fishery lease applications in the area of Clark's Point, Clark's Slough, and Combine Flats on the east side of Nushagak Bay, in Bristol Bay. The area affected by this moratorium includes the east coast of Nushagak Bay north of ADL 224841 and south of ADL 221787, within Sections 11, 12, 13, 14, 23, 24, 25, 26, 35, and 36, Township 15 South, Range 56 West, and Sections 7, 8, 17, 18, 19, 20, 29, 30, 31, and 32, Township 15 South, Range 55 West, Seward Meridian.

In 2022, the Shore Fishery Leasing Program (SFLP) enacted the moratorium in the defined areas to suspend new applications in order to determine if there was adequate spacing for current and additional leases. Furthermore, new diagrams needed to be drafted to accurately depict leases in the area. To date, new diagrams have been submitted for the leases, and while they have not been finalized, we no longer see a benefit in continuing to impose a moratorium. The SFLP will continue to work with existing shore fish leaseholders and the Division of Mining, Land and Water (DMLW) Survey Section to accurately determine lease locations and finalize diagrams. Amendments will be issued if deemed appropriate.

The lifting of this moratorium will in no way affect legal fishing activities by lessees or unleased fishers. Existing applications and lease extensions in the described area will continue to be processed.

If new shore fish lease applications are received for the area, we anticipate insufficient space being available. We will work with the DMLW Survey Section to confirm spacing. Each application will be considered on a case-by-case basis. In the likely occurrence of lack of space, the application will be rejected.

This announcement will be posted on the Alaska Public Notice System website for 30 calendar days and will also be posted on the Shore Fishery Leasing Program website. For more information, please refer to the attached maps or contact the SFLP staff at [email protected].
