Auto Recycler Fined $15,000 for Environmental Protection Act Violation

Convicted - JMG Auto Recyclers and Parts Inc.

Court Location - Peterborough

Description of Offence - The conviction is for failing to comply with a Provincial Officer's Order.

Date of Offence - June 17, 2022, and ending on or about December 22, 2022

Date of Conviction - September 4, 2025

Penalties Imposed -

  • JMG Auto Recyclers and Parts Inc. was convicted of 1 violation under the Environmental Protection Act (EPA), fined $15,000 plus a victim fine surcharge of $3,750, and given 24 months to pay.
  • In addition, a court order under section 190 of the EPA was issued to JMG requiring compliance with the Provincial Officer's Order.

Background -

  • JMG owns a site containing a metal recycling facility and an end-of-life vehicle disposal site located in the Township of Otonabee South-Monaghan.
  • In April 2022, the ministry received notification of a fire at the property. Provincial Officers attended the site and observed steel barrels, propane cylinders, furnace oil tanks, melted plastic totes, approximately 5000 waste tires and remnants of burned tires. Steel drums were leaking oil onto the ground and there were pools of douse water with a hydrocarbon-like sheen and odour. Provincial Officers advised JMG that a spill cleanup was required.
  • In May 2022, a Provincial Officer found that JMG had not begun clean up of the site since the fire and issued a Provincial Officer's Order to JMG.
  • As of September 2025, JMG had not complied with an item in the Provincial Officer's Order that required submitting a report to address, amongst other things, how JMG will ensure that the storage of waste tires complies with the EPA, and a plan to ensure spills or leaks of subject waste materials are prevented.
  • The ministry's Environmental Investigations and Enforcement Branch investigated and laid charges which resulted in the convictions.
