NOTICE TO THE PUBLIC AND REQUEST FOR INFORMATION
Proposal for Issuance of General Permit

For ATV/UTV Use on State Lands

The Department of Natural Resources (DNR), Division of Mining, Land and Water (DMLW), is considering issuing a general permit for All Terrain Vehicle (ATV) and Utility Task Vehicle (UTV) use on DMLW managed lands. For the purpose of the general permit, an ATV/UTV would be defined as any motorized vehicle which is:

• 80 inches or less in width

• Having a curb weight of 2,500 pounds or less

• Designed to travel on four or more non-highway tires

Per 11 AAC 96.020, Generally Allowed Uses (GAU), the use of a recreational-type off-road or all-terrain vehicle weighing over 1,500 pounds requires a permit. The GAU regulation was originally approved in 1970. In the succeeding decades, manufacturers have continuously modified these vehicles resulting in safer, though heavier, machines than what existed during the original legislation. Use of these new vehicles is widespread and ongoing on State lands with no authorization. Issuance of the general permit is not anticipated to cause an increase in impacts. The general permit would allow for this use to be authorized as required by regulation. The general permit proposed would not require an application, however, persons operating under the general permit would need to review the document and have a copy in their possession while operating the ATV/UTV. There would be no fees associated with the general permit. The general permit would not alleviate the need for operators to obtain other permits as necessary nor would it allow use where motorized vehicles are otherwise prohibited, such as Legislatively Designated Areas. Operators under the general permit found to not be adhering to permit stipulations may be required to obtain a land use permit for future activities.

DEADLINE FOR COMMENTS: May 4, 2025

The public is invited to comment on this activity. The purpose of this notice is to gather input before a decision is made on this activity. To ensure consideration, written comments must be received by the Division of Mining, Land and Water at PO Box 111020, Juneau, AK 99811 on or before 5:00 p.m. on the date noted above. After review and adjudication, we may issue an authorization with stipulations for the activity. The activity may be modified during the review and adjudication process.
