This opinion considers the effects of all in-water activities, including vessel transit of materials and construction barges, removal and installation of piles, and underwater welding, as well as the associated proposed issuance of an IHA.
The action may affect the endangered Western Distinct Population Segment (DPS) Steller sea lion, endangered Western North Pacific and Central America DPS humpback whale, threatened Mexico DPS humpback whale, endangered fin whale, endangered North Pacific Right Whale, and endangered Southern Resident DPS killer whale. The project is also located in critical habitat for the Western DPS Steller sea lion and Western North Pacific DPS humpback whale, and project dedicated vessels may transit through critical habitat for the Western North Pacific, Mexico, and Central America DPS humpback whales, Western DPS Steller sea lion, Western North Pacific right whale, and Southern Resident DPS killer whale. There is no critical habitat designated for fin whales.
This biological opinion is based oninformation provided in the Biological Assessment and subsequently submitted take estimates and updated effects determinations, and the IHA application and the proposed IHA (91 FR 12148; March 12, 2026).
