Project Description:
A State Pollutant Discharge Elimination System (SPDES) department-initiated permit modification has been drafted for the Jones Beach State Park facility located at One Ocean Parkway, Wantagh, NY 11793.
Adopted June 4, 2019, effective November 1, 2019, the New York State Department of Environmental Conservation (NYSDEC) adopted amendments to Parts 700, 703 and 890 of Title 6 of the Official Compilation of Codes, Rules, and Regulations of the State of New York (6 NYCRR). These amendments establish new water quality standards for all coastal recreational waters to meet the requirements of the federal Beaches Environmental Assessment and Coastal Health (BEACH) Act of 2000 (P.L. 106-284). The Jones Beach State Park facility has a surface water discharge of 1.5 million gallons per day of treated sanitary wastewater to the Atlantic Ocean and is regulated under this act.
Permit and factsheet changes include new final effluent limitations for Enterococci and modifying the Schedule of Compliance to include a Bacterial Assessment Study (BAS) for Enterococci and allow for additional time to develop a workplan, conduct sampling, carry out studies, and install upgrades necessary to meet the new final effluent limitations.

Requests for a legislative (public statement) hearing must be sent in writing to the DEC contact person below by the comment deadline. The Department assesses such requests pursuant to 6 NYCRR Section 621.8. Refer to this application by the application number listed above and SPDES Number NY0030104.

State Environmental Quality Review (SEQR) Determination:
Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination:
The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.
Coastal Management:
This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)
It has been determined that the proposed action is not subject to CP-29.
