Reps. Cherfilus-McCormick and Chu Reintroduce the Federal Disaster Housing Stability Act

WASHINGTON, D.C. - Today, Representatives Sheila Cherfilus-McCormick (D-FL) and Judy Chu (D-CA) reintroduced the Federal Disaster Housing Stability Act of 2025, a critical piece of legislation designed to protect homeowners and renters from eviction or foreclosure following natural disasters such as hurricanes, floods, earthquakes, and wildfires.

This legislation ensures that individuals and families affected by federally declared disasters are not further victimized by housing insecurity caused by unforeseen economic hardship.

"Natural disasters can strike any family, at any time, and in any place," said Rep. Cherfilus-McCormick (D-FL). "Over the past couple of years, Florida has experienced an increasing number of devastating hurricanes and floods that have uprooted entire communities. The American people deserve the opportunity to rebuild their neighborhoods with dignity and without the fear of losing their homes."

"In the aftermath of a natural disaster, survivors who have already endured devastating loss should not also have to worry about being evicted or their homes being foreclosed," said Rep. Chu (D-CA). "Unfortunately, that is the reality for far too many survivors, including many of my constituents who are continuing to rebuild and recover from the Eaton Fire, the second most destructive wildfire in California's history. That's why I'm proud to join my colleague Rep. Cherfilus-McCormick (D-FL) in introducing the Federal Disaster Housing Stability Act to ensure that survivors are protected from evictions and foreclosures in the direct aftermath of a natural disaster."

When natural disasters strike, they displace people from their homes, their jobs, and their communities, creating significant financial challenges. Yet homeowners and renters do not automatically receive protections from foreclosure and eviction in the immediate aftermath," said Alys Cohen, Director of Federal Housing Advocacy at the National Consumer Law Center. "The Federal Disaster Housing Stability Act will protect disaster survivors from displacement and home loss and help keep neighborhoods intact."  

Key Provisions of the Federal Disaster Housing Stability Act of 2025:

120-Day Moratorium on Evictions: During a disaster declared by the President, a state governor, the Mayor of Washington, D.C., or a Tribal Chief Executive, landlords, lessors, and property owners may not:

  • Issue a notice to vacate,
  • Require tenants to leave the property, or
  • Increase the cost of rent or related fees, including late fees.

6-Month Moratorium on Foreclosures: Mortgage servicers are prohibited from:

  • Initiating judicial or non-judicial foreclosure proceedings,
  • Scheduling a foreclosure sale,
  • Seeking a foreclosure judgment or order of sale, or
  • Carrying out any eviction or sale related to foreclosure.

The bill has received endorsements from the National Consumer Law Center and the National Housing Law Project.
