Defendant Convicted of Shooting at Inhabited Vehicle

On August 26, 2026, Devin Devon Smith was convicted by a jury of two counts of assault with a deadly weapon, with the allegation that Smith used a firearm found true on both counts. Smith was also convicted of discharging a firearm at an inhabited vehicle and felon in possession of a firearm. An allegation that Smith has a prior strike conviction for burglary was found true along with aggravating factors that Smith used a weapon and has engaged in violent conduct that poses a serious danger to society.

On December 26, 2022, the victims were in a truck stopped at a red light. Devin Devon Smith was seated in the passenger seat of a car that drove in front of the truck. As they passed the truck, Smith leaned out of his window, aimed a gun at the victims, and fired two times. One of those two shots hit the victims' truck just below the rear passenger side window, missing the victims. The victims did not know Smith or why he shot at them. The victims identified Smith as the shooter. Additional evidence including a shell casing found underneath Smith's floor mat linked Smith to the shooting.

Smith faces a maximum sentence of 24 years in prison. Sentencing is set for September 11, 2026, at 1:30 PM in Dept. 11A before the Honorable Carlton Davis.
