AAMC Statement on 1st Circuit Court of Appeals Ruling in NIH Lawsuit

The AAMC issued the following statement on the 1st Circuit Court of Appeals decision to affirm a March 2025 U.S. District Court ruling, which maintained an injunction against harmful cuts to research funded by the National Institutes of Health (NIH):

"The AAMC is pleased that the 1st Circuit Court of Appeals has affirmed the district court's ruling last March that the administration's attempt to cut facilities and administrative (F&A) reimbursement rates for NIH-funded research with no notice was unlawful. The appeals court ruling means that fair and necessary support for the real costs of conducting medical research will continue for the benefit of patients and communities across the country."

Background

The AAMC, with the American Association of Colleges of Pharmacy, the Association of Schools and Programs of Public Health, Conference of Boston Teaching Hospitals, and Greater New York Hospital Association, along with other plaintiffs in separately-filed actions, had successfully argued in a February 10, 2025 lawsuit in the District Court for the District of Massachusetts that a Feb. 7, 2025, notice issued as "supplemental guidance" to the NIH Grants Policy Statement was unlawful and would result in irreparable harm.
